Mattress 10 Year Limited Warranty

The quality built into every Contempo Comfort Mattress allows us to guarantee for a period of 10 (ten) years from the date of original purchase that your Mattress will be addressed in the unlikely event of defects in materials or workmanship which occur during the term of this limited warranty. 

This limited warranty covers any physical flaw in the mattress that causes the foam to split or crack despite normal usage and proper handling.  It does not cover conditions resulting from normal wear and tear.  Use of the product diminishes the loft of the foam.  Since this is an anticipated characteristic of the foam, Contempo makes no warranty with respect to the natural compression of the foam.  This limited warranty does not cover normal increases in softness of the foam or a decrease in its recovery aspects, which are also anticipated characteristics of the foam but which do not affect the pressure-relieving qualities.  Furthermore, Contempo shall not be obligated to provide warranty service if the product is found to be damaged, burned, cut, torn, misused, stained, soiled, in an unsanitary condition or when product failure is due to causes other than defective material or workmanship.  This warranty is valid only to the original purchaser of the product.  This limited warranty gives you specific legal rights and you may also have other rights that vary from state to state.

In the unlikely event that service resulting from a covered defect is required, Contempo will either repair, replace or pick-up at its option any part or product, which has a defect in materials or workmanship covered by this Limited Warranty.  Contempo reserves the right to change specifications without notification.  If identical materials are unavailable at the time of repair, Contempo reserves the right to substitute materials. Claims of any defect must be submitted within 24 hours of occurrence in writing supported with detailed descriptions and photographs. This warranty is for replacement parts ONLY and does not include any freight, delivery, installation or set-up related charges that may be associated with the claim.

IMPORTANT NOTE ON BODY IMPRESSIONS:

Body impressions are normal during the first course of use.  This is not a structural defect, but simply the settling of foam layers.  Please observe the following to protect your investment so you can enjoy a great night’s sleep for years to come…

Do…

-          Rotate your mattress frequently.  Your mattress will conform to your body contours for extra comfort and support.

-          Rotate once every 2 weeks for the first 3 months of use, once every 2 months thereafter if you notice an uneven surface.

-          Use a mattress pad.

-          Water or other stains will be considered abuse and will void bedding warranties from all manufacturers.

Do Not…

-          Do not stand or jump on the bed.  This will abuse your bedding and void your warranty.

Important Information:

This Limited Warranty extends only to the original residential consumer purchaser.  Contempo liability under this Limited Warranty is limited to repair, replacement or pick-up of the defective product at its option.  THIS WARRANTY IS IN LIEU OF ALL OTHER WARRANTY, EXPRESSED OR IMPLIED, INCLUDING WITHOUT LIMITATION, ANY WARRANTY OF MERCHANT ABILITY OR FITNESS FOR A PARTICULAR PURPOSE.  TO THE EXTENT ANY IMPLIED WARRANTY IS REQUIRED BY LAW, IT IS LIMITED IN DURATION TO THE EXPRESS WARRANTY PERIOD ABOVE. IN NO EVENT SHALL CONTEMPO, ARDIN, THE DISTRIBUTOR AND/OR DELIVERY COMPANY BE LIABLE FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES OF ANY KIND. NO REPRESENTATIVE OF CONTEMPO, ARDIN OR ITS DISTRIBUTORS, DELIVERY AGENTS, RESELLERS OR DEALERS IS AUTHORIZED TO MAKE ANY CHANGES OR MODIFICATIONS TO THIS WARRANTY. SOME STATES DO NOT ALLOW LIITATIONS OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU.  For all photos, videos, reviews, comments, feedback, suggestions, ideas, and other submissions taken, recorded, photographed, disclosed, submitted or offered to Contempo or its agents on or through delivery, by e-mail or telephone, or otherwise (collectively, the “Comments”) you grant Contempo a royalty-free, irrevocable, transferable right and license to use the Comments however Contempo desires, including without limitation, to copy, modify, delete in its entirety, adapt, publish, translate, create derivative works from and/or sell and/or distribute such Comments and/or incorporate such Comments into any form, medium or technology throughout the world. This warranty gives you specific rights and you may also have other rights, which vary from state to state.  None of these warranties apply to rental business, commercial, institutional or other non-residential uses or to anyone other than the original residential consumer purchaser.  All warranty service charges will be quoted, authorized, scheduled and performed during regular operational hours.  Unfortunately, requests for specific dates or time frames cannot be honored.  Parts for warehouse drop offs will be shipped freight collect.  All warranties shall become void when account balances are delinquent or in dispute. All parties and assignees agree that any disputes or claims will be settled in Passaic County, New Jersey.
