Limited Lifetime Warranty

Contempo will either repair, replace or pick-up at its option any part or product, which has a defect in materials or workmanship covered by this Limited Warranty.  Contempo reserves the right to change specifications without notification.  If identical materials are unavailable at the time of repair, Contempo reserves the right to substitute materials. Claims of any defect must be submitted within 24 hours of occurence in writing supported with detailed descriptions and photographs. This warranty is for replacement parts ONLY and does not include any delivery, installation or set-up related charges that may be associated with the claim.

The Warranty Does Not Cover:

 - Damage due to misuse, abuse, accident, or moving the furniture from the original delivery location
 - Damage or discoloration caused by sunlight, oxidization and/or artificial lighting sources
 - Warpage, de-silvering caused by natural seasonal weather changes
 - Variations in the color or graining of wood, wood products, leather, fabric or marble
 - Blemishes, telegraphing, variations and/or any other markings inherent in the material and/or finish
 - Scratches, chips or breakage to mirror, glass or stone (natural or man-made) not noted at the time of delivery
 - Mattresses and all upholstery seating items
-  Property damage claims not noted on the bill of lading at the time of delivery
 - Door and drawer alignment, gaps and/or leveling
 - Merchandise that has been altered or otherwise modified
 - Light bulbs and light fixtures
 - Damage caused in shipping or transit via common carrier or pick-up
 - Delivery, installation, placement and/or any other set-up related services
 - Any subsequent claims when delivery is received by a proxy

Important Information:

This Limited Warranty extends only to the original residential consumer purchaser.  Contempo liability under this Limited Warranty is limited to repair, replacement or pick-up of the defective product at its option.  THIS WARRANTY IS IN LIEU OF ALL OTHER WARRANTY, EXPRESSED OR IMPLIED, INCLUDING WITHOUT LIMITATION, ANY WARRANTY OF MERCHANT ABILITY OR FITNESS FOR A PARTICULAR PURPOSE.  TO THE EXTENT ANY IMPLIED WARRANTY IS REQUIRED BY LAW, IT IS LIMITED IN DURATION TO THE EXPRESS WARRANTY PERIOD ABOVE. IN NO EVENT SHALL CONTEMPO, ARDIN, THE DISTRIBUTOR AND/OR DELIVERY COMPANY BE LIABLE FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES OF ANY KIND. NO REPRESENTATIVE OF CONTEMPO, ARDIN OR ITS DISTRIBUTORS, DELIVERY AGENTS, RESELLERS OR DEALERS IS AUTHORIZED TO MAKE ANY CHANGES OR MODIFICATIONS TO THIS WARRANTY. SOME STATES DO NOT ALLOW LIITATIONS OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU.  For all photos, videos, reviews, comments, feedback, suggestions, ideas, and other submissions taken, recorded, photographed, disclosed, submitted or offered to Contempo or its agents on or through delivery, by e-mail or telephone, or otherwise (collectively, the “Comments”) you grant Contempo a royalty-free, irrevocable, transferable right and license to use the Comments however Contempo desires, including without limitation, to copy, modify, delete in its entirety, adapt, publish, translate, create derivative works from and/or sell and/or distribute such Comments and/or incorporate such Comments into any form, medium or technology throughout the world. This warranty gives you specific rights and you may also have other rights, which vary from state to state.  None of these warranties apply to rental business, commercial, institutional or other non-residential uses or to anyone other than the original residential consumer purchaser.  All warranty service charges will be quoted, authorized, scheduled and performed during regular operational hours.  Unfortunately, requests for specific dates or time frames cannot be honored.  Parts for warehouse drop offs will be shipped freight collect.  All warranties shall become void when account balances are delinquent or in dispute.

All parties and assignees agree that any disputes or claims will be settled in Passaic County.
